ETS requires GRE and TOEFL test-takers to sign a confidentiality agreement that is not uncommon on IT certification exams:

If I reproduce test questions in any manner I am subject to a copyright infringement lawsuit and any other action(s) ETS may take.

Tech: Yahoo! News - School Teaches ‘Ethical Hacking’ to Computer Students: I am dubious. Some of their certification exams are offered through Prometric’s web-based service, which makes saving the questions as easy as using a digital camera or a screen capture program. The Prometric testing centers try to check for cheating. And their logo looks a lot like Net Guru’s CIW logo. I sometimes wish Prosoft had ackowledged that there are many other CIWs. “The course prepares students for an exam offered by the International Council of E-Commerce Consultants, or EC-Council. If they pass that test, they get the ultimate seal of approval: Certified Ethical Hacker. The class is by no means easy. Instructors race through topics like symmetric versus asymmetric key cryptography (symmetric is faster), war dialing (hackers will always call late at night) and well-known TCP ports and services (be wary of any activity on Port 0). ”
